Unpacking the DOJ’s Crypto Enforcement Memo

Earlier this month, the Department of Justice disbanded its National Cryptocurrency Enforcement Team and said it would no longer pursue what Deputy Attorney General Todd Blanche described as ’regulation by prosecution.’ Instead, the DOJ will refrain from litigation or enforcement actions that impose regulatory frameworks on digital assets, allowing regulatory agencies to establish their own oversight frameworks. This decision was outlined in a 4-page memo signed by Deputy Attorney General Todd Blanche on April 7.
